Provider Agreement

ASPR/CDC Mpox Vaccination Operational Planning Guide - HHS Mpox Vaccination Program

All entities receiving mpox vaccine doses, including entities that receive mpox vaccine directly and local sites where vaccines are redistributed are subject to compliance with the requirements of the Provider Agreement for the HHS Mpox Vaccine Program. Additional information is provided here to describe how the provider agreement must be distributed and used.


Provider Agreement and Redistribution 

In the context of local redistribution of vaccines beyond the initial delivery sites, the health department that places the order through HPOP is required to agree to ensure the following:

  • The health department will send a link to the provider agreement webpage Mpox Vaccination Program Provider Agreement or a copy of the provider agreement to every vaccinating provider/organization receiving mpox vaccine doses with every shipment of vaccine.
  • The health department will notify CDC (poxvirus@cdc.gov) regarding the means used to send the provider agreement to every vaccinating provider/organization with every vaccine order. The preferred method of sending the provider agreement to providers/organizations is as an attachment or link to the HHS MPX Vaccine Provider Agreement webpage to the vaccine order confirmation e-mails sent to the provider/organization by the health department to confirm shipment of each vaccine order. The confirmation e-mail, or other direct written communication to each provider/organization, must highlight that the provider agreement is attached by stating: “Attached is a copy or link to the Provider Agreement for the HHS Mpox Vaccination Program. Your organization is expected to comply with all its requirements. Upon any use of the JYNNEOS™ or ACAM2000® vaccine provided at no cost by the US government, the provider and provider’s organization (Organization) will be deemed to have agreed to comply with the requirements of the Provider Agreement, including any updates.”


Applicability of Provider Agreements to HPOP-ordering Entities When Also Acting as a Vaccinator

All entities that receive mpox vaccine doses directly from the SNS through an HPOP order that intend to directly administer any of those doses as a vaccinating provider are subject to compliance with the requirements of the Provider Agreement for the HHS Mpox Vaccination Program. Upon any use of the JYNNEOS or ACAM2000 vaccine provided at no cost by the US government, the provider and provider’s organization will be deemed to have agreed to comply with the requirements of the Provider Agreement, including any updates.
